Good News: Judge Rules in Favor of Expelled Documentary

A district judge sided with actor and filmmaker Ben Stein on Monday, ruling that use of John Lennon's song Imagine in his Expelled documentary falls within "fair use."

"The fair use of a copyrighted work for purposes of criticism and commentary is not an infringement of copyright," U.S. District Judge Sidney Stein said.

Lennon's sons and widow, Yoko Ono, had filed suit in April seeking removal of the song from the movie.

Expelled, which chronicles the censorship of teachers, professors and students who question the theory of Darwinian evolution, has garnered Dr. James Dobson's endorsement.
