The 3rd U.S. Circuit Court of Appeals on Monday upheld a lower-court ruling against Temple University's speech-code policy after a student challenged it because his freedom of expression was limited.
The Alliance Defense Fund (ADF) filed a lawsuit in 2006 on behalf of Christian DeJohn, a sergeant in the Pennsylvania Army National Guard, who said his attempts to earn a master's degree were impaired after he expressed his political views in class about the war.
A federal judge issued a permanent injunction against the university's policy in March 2007.
“Christian and conservative students shouldn’t fear discrimination or censorship by university officials simply for expressing their beliefs," ADF Senior Counsel Nate Kellum said. "The university is a ‘marketplace of ideas,’ where all viewpoints are welcomed, and this significant ruling makes that clear."
