The Alliance Defense Fund (ADF) has filed a brief with the 5th U.S. Circuit Court of Appeals in support of a Texas law that provides for a minute of silence following the Pledge of Allegiance.
Students can reflect, pray, meditate or engage in silent activity that does not distract others. In 2007, some parents sued, claiming the requirement “causes harm” to their children and violates the First Amendment.
ADF Senior Counsel David Cortman said the parents have failed to demonstrate that their children have suffered.
“A moment of silence is not a government endorsement of religion just because someone might use the time for prayer,” he said. “No student is compelled to pray under the Texas law."
