Judge Rules in Favor of 'Transsexual' Job-Seeker

 

A U.S. district judge ruled Friday that the Library of Congress was wrong to discriminate against David Schroer, a retired U.S. Army Special Forces commander who was not given a job because he was undergoing surgery to look like a woman.

The American Civil Liberties Union filed a lawsuit in 2005 on Schroer's behalf.

Bruce Hausknecht, judicial analyst for Focus on the Family Action, said this is an absurd ruling — one he hopes will be overturned.

"Judge James Robertson, a Clinton appointee, traded in his judge's robe for a legislator's pen in order to achieve something contrary to the law and previous federal court decisions," he said. "He effectively amended the federal employment laws to grant protected status to persons suffering from gender-identity disorder, thereby equating it with race, sex or religion."

The Justice Department is reviewing the ruling. The judge will decide penalties at a later date.
