Californians Wait to Hear Marriage Decision

 

A Proposition 8 defense lawyer said the plaintiffs must prove voters were ‘irrational’ when they chose to preserve the traditional definition of marriage.

Now that the arguments for and against protecting marriage in California have been made, the judge will take time to examine everything that was presented.

The trial lasted two and a half weeks.

Closing arguments in the California marriage amendment trial, Perry v. Schwarzenegger, are expected to take place in March or April.

In 2008, Californians voted in favor of Proposition 8, which defined marriage as between one man and one woman in the California Constitution.

Austin Nimocks, senior legal counsel with the Alliance Defense Fund, said the defense feels comfortable and confident with the proceedings.

"We're not required to prove anything," he said. "It's the plaintiffs' burden to prove that the voices of over 7 million Californians that voted for Proposition 8 are somehow unconstitutional."

Many legal experts expect the trial could make its way to the U.S. Supreme Court.

A poll conducted by Angus Reid Public Opinion shows that 58 percent of Americans would prefer the Supreme Court keep the definition of marriage intact. Additionally, 52 percent believe the court would rule in favor of one-man, one-woman marriage.

Melissa Fryrear, youth and gender issues analyst with Focus on the Family, said the poll reflects what the majority of Americans have said for years: Don't tamper with marriage.

"Most people understand that marriage has always been, and needs to remain, that sacred institution only between one man and one woman," she said. "The people throughout this country have voiced their opinion, and it would be welcome news for the people's will to be upheld by our country's court system as well."
