With 37 percent of the precincts reporting, the battle over the definition of marriage in Colorado has been called with Amendment 43 passing by 57 percent of the popular vote.
Colorado had two proposals relating to marriage on the ballot -- Amendment 43, which defines marriage as the union of one man and one woman, and Ref. I, which would create domestic partnerships for same-sex couples with all the equivalent benefits of marriage. Ref. I is currently failing, 45-to-55 percent, with 38 percent of precincts reporting.
Colorado becomes the 25th state to define marriage in its constitution.
