The Federal Communications Commission has learned playing nice with Fox does not work. The network is refusing to pay the fine calling it "capricious" and "unconstitutional" among other things. Daniel Weiss is with Focus on the Family Action.
"There's some real hubris here. These networks do not care what America's standards for decency are at all."
In a separate action, ABC, CBS, NBC and Fox are all involved in a Supreme Court case against the FCC. Dan Isett at the Parents Television Council says the goal is much larger than a few fines, no matter how big.
"What they want to do is do away with any rules and they want the ability, the 'right', to air indecent programming in front of every child in America."
In fact, Weiss says broadcast television can legally air some pretty raunchy material as it is.
"If a network wants to air some kind of edgy content, they really have the right to do so, after 10pm. They're choosing to do it during prime-time when millions of kids are in the audience and they're doing it because they think they can make more money that way."
And Isett says the networks haven't really paid any fines in more than two years.
"That's absolutely correct and the times that they have been paid, they've only been paid so they can continue their legal challenge to the case."
